The LGPS McCloud remedy regulations came into force from 1 October 2023.
To find out if you are affected, you can use this handy tool: Am I affected?
More information can be found by visiting the McCloud section of the LGPS Scotland website. Here you will find a short video where you can learn more, a list of FAQs and details about what happens if your pension might be affected.
Members do not need to do anything. If you or someone you know is contacted by a third-party organisation selling a service to help you claim additional pension you should not engage with them. These claims could be costly and are unnecessary because, if you’ve been affected you automatically benefit from any protection that’s provided. You also risk sharing any benefits you would automatically receive with a third party.
We will work out if you are protected, if you qualify for underpin protection, we will work out if your pension will increase because of the underpin. Any increase is known as a 'final guarantee amount'.
Not many members will get a 'final guarantee amount' because, for most members, the pension they built up in the career average scheme is higher than they would have built up in the final salary scheme.
If you are an active or deferred member, we will include information about how the underpin might affect your pension in your 2025 benefit statement.
If we are already paying your pension, we will review it. If you are due an increase, we will pay you arrears of pension payments with interest. We will do this as soon as we can after 1 October 2023. We have many thousands of pensions to review and this process will take many months. You do not need to contact us. Please be assured that we will contact anyone whose pension in payment will increase because of the McCloud remedy. We will only write to you if the new rules mean that your pension will increase.
